歡迎使用 FogRover（以下稱「本 App」）。本 App 由個人開發者 candan（以下稱「我們」）開發與提供。
在下載、安裝或使用本 App 之前，請閱讀本服務條款（以下稱「本條款」）。一旦你開始使用本 App，即表示你同意本條款。 若你不同意，請不要使用本 App，並自你的裝置移除它。
1. 本 App 是什麼
FogRover 是一款 iPhone 上的步行探索遊戲。你在真實世界中移動，App 會在裝置上撥開一張虛擬地圖上的迷霧，並據此發放遊戲內的獎勵、寵物與成就。
本 App 是 100% 裝置端運作：沒有帳號、沒有註冊、沒有我們自營的伺服器。所有遊戲資料都存放在你的 iPhone 上。詳細說明請見〈隱私權政策〉。
2. 授權範圍
在你遵守本條款的前提下，我們授予你一項個人、非專屬、不可轉讓、不可再授權、可撤回的授權，供你在你所擁有或控制的 Apple 裝置上，依 App Store 的使用規則安裝並使用本 App。
除法律另有強制規定外，你不得：
- 為商業目的轉售、出租、出借、散布本 App，或向第三方收費提供本 App 的存取；
- 對本 App 進行反向工程、反編譯、反組譯，或試圖取得其原始碼；
- 修改本 App，或製作衍生作品；
- 移除或變更本 App 內任何著作權、商標或其他權利標示；
- 使用自動化工具、模擬定位（GPS 偽造）、修改裝置時間、竄改本機資料庫，或以任何非實際步行的方式取得遊戲內獎勵；
- 以會干擾本 App 正常運作，或損害其他使用者權益的方式使用本 App。
3. 你不需要帳號
本 App 沒有帳號系統，我們不會要求你註冊、登入或提供任何個人識別資料。
這帶來一個你必須知道的後果：你的遊戲進度綁在這支裝置上。 若你未使用 App 內的 iCloud 備份功能，則刪除 App、重置或遺失裝置時，進度將無法復原，我們也無法為你找回——我們手上從來沒有你的資料副本。
4. 年齡
本 App 適合一般大眾使用，不含使用者自製內容、聊天或交友功能。
若你未滿 18 歲，或依你所在地法律尚未達到可獨立締約的年齡，請在取得家長或監護人同意後再使用本 App，App 內購買尤其應取得同意。若你是家長或監護人，建議你使用 iOS 的「螢幕使用時間」設定管理 App 內購買。
5. 安全：這是最重要的一節
本 App 會鼓勵你在真實世界中走動。請務必注意：
- 請不要一邊走路一邊盯著螢幕。 過馬路、上下樓梯、行經車道與月台時，請收起手機。
- 請隨時留意周遭環境與交通狀況。 遊戲內的獎勵、寵物、成就或任何倒數計時，都不值得你冒任何風險。
- 請遵守當地法令與現場規定。 不要為了開圖而進入私有土地、施工區域、鐵道、軍事或管制區域，或任何禁止進入的場所。
- 請勿在駕駛車輛時操作本 App。
- 請依自身身體狀況決定運動量。 若你有任何健康疑慮，請先諮詢醫師。
你為自己在使用本 App 期間的一切行為與人身安全負完全責任。 在法律允許的最大範圍內，我們對於你在使用本 App 過程中，於真實世界所發生的任何人身傷害、財產損失或法律責任，不負賠償責任。
6. 本 App 的地圖不是導航工具
本 App 顯示的地圖是在你的裝置上即時生成的虛擬世界，並非真實世界的街道圖資。它與真實世界共用同一組經緯度座標，但不包含道路、路徑、地形危險或任何真實世界的通行資訊。
請勿將本 App 用於導航、定位求援、路線規劃或任何安全相關用途。
App 內顯示的景點資訊來自離線的公開資料集（見第 11 節），可能過時、不完整或有誤。
7. 步數與活動資料不是醫療資訊
本 App 讀取 iPhone 的計步資料，用於換算遊戲內獎勵。所顯示的步數、距離與熱量為估計值，其準確度取決於裝置感測器與你攜帶手機的方式。
這些數字僅供參考與娛樂用途，不構成醫療建議，也不得用於任何醫療、診斷或健康管理目的。
8. 購買、訂閱與自動續訂
本 App 提供以下 App 內購買項目，全部透過 Apple 的 App Store 進行：

關於自動續訂訂閱，請特別注意：
- 訂閱會自動續訂，除非你在當期結束前至少 24 小時關閉自動續訂。
- 續訂費用會在當期結束前 24 小時內向你的 Apple 帳戶收取。
- 你可以隨時在 iOS「設定」→ 你的 Apple 帳戶 →「訂閱項目」中管理或取消訂閱。在 App 內刪除本 App 並不會取消訂閱。
- 取消將於當期結束時生效；當期剩餘時間仍可使用訂閱權益。
- 訂閱期間已發放的鑽石津貼，於取消後仍保留在你的帳上。
價格一律以 App Store 上顯示的當地價格為準。價格可能因地區、匯率與稅制而不同，我們亦可能調整未來的價格（既有訂閱的價格調整將依 Apple 的規則事先通知你）。
9. 鑽石與遊戲內物品
「鑽石」與所有遊戲內物品（寵物、皮膚、徽章、成就等）是有限的、可撤回的、不可轉讓的授權使用權，僅供在本 App 內使用。
明確地說：
- 鑽石不是真實貨幣、虛擬貨幣或任何形式的財產權；
- 鑽石與遊戲內物品不可兌換為現金、不可出售、不可轉讓給他人、不可在 App 外交易；
- 我們不保證任何遊戲內物品的持續可用性、價值或稀有度；
- 遊戲的數值與規則（機率、上限、獎勵）可能於未來版本中調整。
10. 退款
本 App 的所有購買均由 Apple 處理，我們不經手你的付款，也無法直接為你退款。
退款請依 Apple 的程序辦理：前往 reportaproblem.apple.com 或聯絡 Apple 支援。是否退款由 Apple 依其政策決定。
若你的購買已完成扣款但 App 內未正確發放，請先嘗試 App 內的「回復購買」。若仍有問題，請聯絡我們（見第 17 節），我們會協助你釐清。
11. 智慧財產權
本 App 及其所有內容——包含程式碼、美術、音效、文案、遊戲設計與「FogRover」名稱與標誌——均為我們或授權人所有，受著作權與其他法律保護。本條款未明示授予的權利，均予保留。
本 App 使用了若干公開授權的離線資料集與開源軟體，其來源標示與授權條款列於 App 內的「關於 → 開源授權」頁面。使用該等資料與軟體時，你同時受其各自授權條款拘束。
你在本 App 中產生的「時空記憶明信片」等圖像，你可自由分享與使用。
12. 社交功能
本 App 的社交功能（Game Center 排行榜、隊伍共享開圖）預設為關閉，需由你主動開啟。開啟後：
- Game Center 排行榜與成就由 Apple 提供與營運，適用 Apple 的服務條款與隱私政策；
- 隊伍共享透過 Apple 的 CloudKit 分享功能運作。你分享給隊友的覆蓋資料為約 5 平方公里一格的粗略解析度，不含街道尺度的行蹤；
- 你應自行判斷要與誰組隊。只與你信任的人分享。 我們無法控制隊友如何使用他所看到的資訊；
- 你可隨時退出隊伍；退出後，隊友裝置上你的那一份覆蓋資料將被清除。
不得利用社交功能進行騷擾、跟蹤，或以任何方式侵害他人權益。
13. 免責聲明
在法律允許的最大範圍內，本 App 係以「現況」與「現有」基礎提供，我們不作任何明示或默示的擔保，包括但不限於適售性、特定目的適用性、不侵權，以及不中斷或無錯誤運作的擔保。
我們不保證：本 App 能在所有裝置或 iOS 版本上正常運作；定位、步數或任何計算結果的準確性；資料不會因裝置故障、系統更新、App 缺陷或你的操作而遺失。
14. 責任限制
在法律允許的最大範圍內，我們對於因使用或無法使用本 App 所生的任何間接、附帶、衍生、特殊或懲罰性損害（包括資料遺失、利潤損失、遊戲進度損失）不負責任。
在任何情況下，我們就本條款所負的全部責任總額，不超過你在請求發生前 12 個月內，為本 App 實際支付予我們的金額（若你未付費，則為零）。
本節不排除或限制依法不得排除或限制的責任，包括因故意或重大過失所致的人身傷害之責任。
15. 服務變更、中止與終止
我們可能隨時更新、修改、暫停或停止本 App 或其任一功能，恕不另行個別通知。我們亦可能停止對舊版 App 或舊版 iOS 的支援。
若你違反本條款，我們得終止本條款授予你的授權。你可以隨時刪除本 App 以終止本條款。
若本 App 全面停止服務，你的裝置上既有的資料不會被我們遠端刪除，但依賴 Apple 服務的功能（iCloud 備份、Game Center、隊伍）可能無法繼續運作。
16. 與 Apple 的關係
你理解並同意：
- 本條款是你與我們之間的約定，不是與 Apple 之間的約定。Apple 不負責本 App 及其內容。
- Apple 沒有義務就本 App 提供任何維護與支援服務。
- 若本 App 未能符合任何適用的擔保，你可通知 Apple，Apple 將退還你購買本 App 的價金（若有）；在法律允許的最大範圍內，Apple 就本 App 不負其他任何擔保義務。
- 因本 App 引起的任何第三方主張（包括產品責任、法規不符、消費者保護或智慧財產權侵害），由我們而非 Apple 負責處理。
- Apple 及其子公司為本條款的第三方受益人，有權以第三方受益人身分對你執行本條款。
- 你聲明你並非位於美國禁運國家或名列美國政府的禁止交易名單中。
- 你在使用本 App 時，應遵守所有適用的第三方協議條款（例如你的電信資費方案）。
17. 其他
條款修改：我們可能修改本條款。重大修改將於本頁公告並更新「最後更新」日期。修改後你繼續使用本 App，即視為接受修改後的條款。
可分性：若本條款任一條文被認定為無效或不可執行，其餘條文仍完全有效。
不放棄：我們未行使或延遲行使本條款下的任何權利，不構成對該權利的放棄。
完整合意：本條款連同〈隱私權政策〉構成你與我們間就本 App 的完整合意。

Welcome to FogRover (the "App"). The App is developed and provided by candan, an independent developer ("we", "us", "our").
Please read these Terms of Service (the "Terms") before downloading, installing, or using the App. By using the App, you agree to these Terms. If you do not agree, please do not use the App and remove it from your device.
1. What the App Is
FogRover is a walking exploration game for iPhone. As you move through the real world, the App clears fog from a virtual map on your device and awards in-game rewards, pets, and achievements accordingly.
The App runs 100% on your device: there are no accounts, no sign-ups, and no servers operated by us. All of your game data stays on your iPhone. See our Privacy Policy for details.
2. Licence
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on Apple devices that you own or control, in accordance with the App Store Terms of Service.
Except where mandatory law provides otherwise, you may not:
- resell, rent, lease, lend, or distribute the App, or provide access to it to third parties for a fee;
- reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;
- modify the App or create derivative works from it;
- remove or alter any copyright, trademark, or other proprietary notices in the App;
- use automation tools, location spoofing (fake GPS), device time manipulation, local database tampering, or any other means of obtaining in-game rewards without actually walking;
- use the App in any way that interferes with its normal operation or harms other users.
3. No Account Required
The App has no account system. We never ask you to register, sign in, or provide any personally identifying information.
This has one consequence you need to know: your progress lives on your device. If you do not use the App's iCloud backup feature, deleting the App or resetting or losing your device will permanently lose your progress. We cannot recover it for you — we have never held a copy of your data.
4. Age
The App is suitable for a general audience. It contains no user-generated content, chat, or social matchmaking features.
If you are under 18, or under the age of legal capacity to enter into contracts where you live, please use the App only with the consent of a parent or guardian, especially for in-app purchases. If you are a parent or guardian, we recommend using iOS Screen Time to manage in-app purchases.
5. Safety — the Most Important Section Here
The App encourages you to move around in the real world. Please be careful:
- Do not stare at your screen while walking. Put your phone away when crossing streets, using stairs, or near roads and platforms.
- Stay aware of your surroundings and of traffic at all times. No in-game reward, pet, achievement, or countdown timer is worth any risk.
- Obey local laws and posted rules. Do not enter private property, construction sites, railways, military or restricted areas, or any place you are not permitted to be, in order to clear fog.
- Never use the App while driving.
- Exercise within your own physical limits. If you have any health concerns, consult a physician first.
You are solely responsible for your own conduct and safety while using the App. To the fullest extent permitted by law, we are not liable for any personal injury, property damage, or legal liability arising in the real world while you use the App.
6. The Map Is Not a Navigation Tool
The map shown in the App is a virtual world generated on your device in real time. It is not real-world street map data. It shares the same latitude/longitude coordinate system as the real world, but it contains no roads, paths, terrain hazards, or any real-world navigational information.
Do not use the App for navigation, emergency location, route planning, or any safety-critical purpose.
Points-of-interest information in the App comes from offline public datasets (see Section 11) and may be outdated, incomplete, or inaccurate.
7. Step and Activity Data Is Not Medical Information
The App reads step data from your iPhone's pedometer to calculate in-game rewards. Steps, distance, and calorie figures shown are estimates whose accuracy depends on device sensors and how you carry your phone.
These figures are for reference and entertainment only. They are not medical advice and must not be used for any medical, diagnostic, or health management purpose.
8. Purchases, Subscriptions, and Auto-Renewal
The App offers the following in-app purchases, all processed through Apple's App Store:

For auto-renewing subscriptions, please note:
- Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your Apple account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription at any time in iOS Settings → your Apple Account → Subscriptions. Deleting the App does not cancel a subscription.
- Cancellation takes effect at the end of the current period; you keep the benefits for the remainder of that period.
- Diamond allowances already granted during a subscription remain yours after cancellation.
Prices are always as displayed on the App Store in your region. Prices vary by region, exchange rate, and tax, and we may change prices for future purchases (price changes affecting existing subscriptions will be notified to you in advance in accordance with Apple's rules).
9. Diamonds and In-Game Items
"Diamonds" and all in-game items (pets, skins, badges, achievements) are a limited, revocable, non-transferable licence to use them within the App.
To be explicit:
- Diamonds are not real currency, virtual currency, or property of any kind;
- Diamonds and in-game items cannot be redeemed for cash, sold, transferred to another person, or traded outside the App;
- We make no guarantee as to the continued availability, value, or rarity of any in-game item;
- Game values and rules (probabilities, caps, rewards) may be adjusted in future versions.
10. Refunds
All purchases are processed by Apple. We do not handle your payment and cannot issue refunds directly.
To request a refund, use Apple's process: visit reportaproblem.apple.com or contact Apple Support. Refund decisions are made by Apple under its own policies.
If you were charged but did not receive your content, first try Restore Purchases in the App. If that does not resolve it, contact us (Section 18) and we will help you work it out.
11. Intellectual Property
The App and all of its content — code, art, audio, text, game design, and the FogRover name and logo — are owned by us or our licensors and protected by copyright and other laws. All rights not expressly granted in these Terms are reserved.
The App includes certain publicly licensed offline datasets and open-source software. Their attributions and licence terms are listed in the App under About → Open Source Licences. Your use of those materials is also subject to their respective licences.
Images you create in the App, such as memory postcards, are yours to share and use freely.
12. Social Features
The App's social features (Game Center leaderboards, team fog sharing) are off by default and must be turned on by you. Once enabled:
- Game Center leaderboards and achievements are provided and operated by Apple, subject to Apple's terms and privacy policy;
- Team sharing works through Apple's CloudKit sharing. The coverage data you share with teammates is at a coarse resolution of roughly 5 square kilometres per cell and contains no street-level movement;
- You decide who to team up with. Share only with people you trust. We cannot control what a teammate does with what they see;
- You may leave a team at any time; when you do, your coverage data is removed from your teammates' devices.
Social features must not be used for harassment, stalking, or to infringe anyone's rights.
13. Disclaimer of Warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not warrant that: the App will work on every device or iOS version; that location, step counts, or any calculated results will be accurate; or that data will not be lost through device failure, system updates, App defects, or your own actions.
14. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages (including loss of data, loss of profit, or loss of game progress) arising from your use of, or inability to use, the App.
In any event, our total aggregate liability under these Terms will not exceed the amount you actually paid us for the App in the 12 months preceding the claim (which is zero if you have not made a purchase).
Nothing in this section excludes or limits liability that cannot be excluded or limited by law, including liability for personal injury caused by wilful misconduct or gross negligence.
15. Changes, Suspension, and Termination
We may update, modify, suspend, or discontinue the App or any of its features at any time without individual notice. We may also end support for older versions of the App or of iOS.
We may terminate the licence granted by these Terms if you breach them. You may terminate these Terms at any time by deleting the App.
If the App is discontinued entirely, we will not remotely delete data already on your device, but features that depend on Apple services (iCloud backup, Game Center, teams) may stop working.
16. Relationship with Apple
You acknowledge and agree that:
- These Terms are between you and us, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- We, not Apple, are responsible for addressing any third-party claim relating to the App, including product liability, regulatory non-compliance, consumer protection, and intellectual property infringement claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you as a third-party beneficiary.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government prohibited-party list.
- You must comply with all applicable third-party terms of agreement when using the App (for example, your wireless data plan terms).
17. General
Changes to these Terms. We may revise these Terms. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the App after a change means you accept the revised Terms.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.
No waiver. Our failure or delay in exercising any right under these Terms does not waive that right.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.
